Insight Clinical and Forensic Psychological Services (Insight) is bound by the Australian Privacy Principles under the Information Privacy Act 2000 (Vic) and the Health Records Act (Vic) 2001 “Privacy Laws”, and other relevant laws about how private health service providers handle personal information (including but not limited to client mental health information).

Insight Body + Mind (“IBM”) is also bound by the Australian Privacy Principles and any other relevant laws relating to the privacy of your personal information.

We are committed to complying with all applicable privacy laws which govern how Insight and IBM collect, use, disclose and store your personal information.

Information we collect from you

In respect of Clients of Insight, Insight will collect your personal information for the purpose of providing you with mental health care and for directly related purposes. For example, Insight may collect, use or disclose personal information for the purposes of:

-       Assessment for provision of mental health care services;

-       Clinical or Forensic psychological assessments;

-       To liaise with health professionals, Medicare or your private health fund;

-       In an emergency where your life is at risk and you cannot consent; or

-       For other purposes required or permitted by law.

Personal information held by Insight will include your name and contact details as well as case notes and reports written by the clinician.  This information is collected directly from the intake worker or your clinician.  With your consent (informed and signed), information may be obtained from other family members, your general practitioner, or from a professional who has treated you in the past.

IBM collect your personal information for the purpose of maximising the services that we provide to you. For example, IBM may collect, use or disclose personal information for the purposes of communicating with you, providing technical support, notifying you of updates and offers, sharing useful content, measuring customer satisfaction, diagnosing problems and providing you with a personalised website experience.

In the course of your visits to our website or use of our products and services, we may obtain the following information about you: name, company name, email address, telephone number, credit card details, billing address, geographic location, IP address, survey responses, support queries, blog comments and social media handles. 

How we use your information

Non-Personally Identifiable Information: We use the information we collect in aggregated and anonymised forms to improve our services, including: administering our website, producing reports and analytics, advertising our products and services, identifying user demands and assisting in meeting customer/client needs generally.

Marketing communications are only sent to you if you have requested or subscribed to them. You can opt out of our marketing communications at any time by unsubscribing or emailing us and your request will be actioned immediately.

Any information you choose to make publicly available, such as blog comments and testimonials on our website, will be available for others to see. If you subsequently remove this information, copies may remain viewable in cached and archived pages on other websites or if others have copied or saved the information.

IBM may use an image of you in any promotional materials, including on its social media platforms.

Your personal information will, otherwise, not be used for any other purpose unless we have your written permission except for statistics gathered for internal quality assurance from which you cannot be personally identified. 

Security and storage of your information

All information about you is stored securely electronically or in locked storage.

We will use all reasonable means to protect the confidentiality of your personal information while in our possession or control. All information we receive from you is stored and protected on our secure servers from unauthorised use or access. Credit card information is encrypted before transmission and is not stored by us on our servers.

To enable us to deliver our services, we may transfer information that we collect about you, including personal information, across borders for storage and processing in countries other than Australia. If your personal information is transferred and processed outside Australia, it will only be transferred to countries that have adequate privacy protections.

We retain your personal information for as long as needed to provide services to you and as otherwise necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

In the event there is a breach of our security and your personal information is compromised, we will promptly notify you in compliance with the applicable law.

Disclosure of your information

We will not use or disclose your personal information to any other persons or organisations for any other purpose unless you have consented or it is specifically required by law.

In exceptional circumstance, Insight is compelled by law to disclose personal information without your written permission.  These are:

-       If your case notes are subpoenaed by the Courts

-       If you appear in danger of harming yourself or others

-       In both cases, your clinician will try and discuss the matter with you first.

-       Access to personal information

IBM may also from time to time need to disclose certain information, which may include your personal information, to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request. Also, we may use your personal information to protect the rights, property or safety of IBM, our customers or third parties.

Insight or IBM may disclose your personal information to our direct debit provider EziDebit to provide you with the services covered by the Direct Debit Request or our Terms and Conditions.

If there is a change of control in one of our businesses (whether by merger, sale, transfer of assets or otherwise) customer information, which may include your personal information, could be transferred to a purchaser under a confidentiality agreement. We would only disclose your personal information in good faith and where required by any of the above circumstances.
